These Terms of Service ("Terms") constitute a legally binding agreement between you and Ekrem Taha Sener, operating under the trade name AdditionalRAM ("Developer", "we", "us", or "our"), governing your access to and use of the mobile video game Ember Ruin (Package ID: com.AdditionalRAM.EmberRuin), our website at additionalram.com, and any associated services, leaderboards, and features (collectively, the "Services").
By downloading, installing, accessing, or playing Ember Ruin, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately cease using the Services and uninstall the game.
You must be at least 16 years of age to access or use the Services. By downloading or accessing Ember Ruin, you represent and warrant that you are at least 16 years old. If you are under the legal age of majority in your jurisdiction, you represent that you have obtained consent from a parent or legal guardian who agrees to be bound by these Terms.
Anonymous Accounts: On initial launch, Ember Ruin automatically provisions an anonymous account using Unity Gaming Services (UGS) to store game progression, unlocked cosmetics, and run records.
Account Linking: You may choose to link your anonymous account to Google Play Games. You are solely responsible for maintaining the security of your device and third-party login credentials. We are not liable for any loss of save data, purchases, or account progress resulting from device replacement, operating system resets, cache clearing, or unlinking third-party credentials.
Virtual Currency ("Tears"): Ember Ruin features an in-game virtual currency referred to as "Tears." Tears can be earned through gameplay or purchased via authorized In-App Purchases (IAP). Tears exist solely within Ember Ruin, have no real-world monetary value, and do not constitute real currency, property, or an investment. You may not redeem, trade, sell, or exchange Tears for real money or physical goods.
Virtual Items & Cosmetics: Tears can be redeemed to unlock virtual items, including profile name colors, cosmetic skins, and prefixes. All virtual goods are licensed, not sold. You receive a limited, revocable, non-exclusive, non-transferable license to use virtual goods strictly within Ember Ruin for your personal entertainment.
VIP Purchase: You may purchase a one-time "VIP" upgrade via In-App Purchase. VIP status grants specified perks, including the removal of third-party advertisements and access to exclusive profile cosmetic options. VIP status is non-transferable and tied to your account.
All financial transactions are processed directly by third-party storefronts (such as the Google Play Store). We do not collect, process, or store credit card numbers, billing addresses, or payment credentials.
All Sales Are Final: To the maximum extent permitted by applicable law, all purchases of Tears, VIP status, and digital content are final, non-refundable, and non-exchangeable.
If you reside in the European Union or United Kingdom, by initiating an In-App Purchase, you expressly consent to the immediate delivery of digital content and acknowledge that your statutory right of withdrawal is waived once performance has begun. Any dispute or refund request must be submitted directly through Google Play in accordance with Google Play's standard refund policies.
Ember Ruin features global public leaderboards hosted on Unity Gaming Services. To maintain fair competition, the following activities are strictly prohibited:
Enforcement: We reserve the absolute right, without prior notice, to delete fraudulent leaderboard entries, reset scores, restrict online functionality, or permanently revoke account access for any user found violating these fair play standards.
While Ember Ruin does not feature in-game direct messaging or text chat, your customized username, cosmetic skins, equipped prefixes (such as [VIP]), and top run statistics are publicly visible on global leaderboards.
You agree that your username will not contain text that is defamatory, obscene, harassing, hateful, discriminatory, sexually explicit, or infringing upon third-party intellectual property rights. We reserve the unilateral right to reset, redact, or overwrite any username deemed inappropriate.
All rights, title, and interest in and to Ember Ruin—including all source code, software, character art, sound assets, mechanics, visual design, animations, trademarks, and logos—are the exclusive intellectual property of Ekrem Taha Sener (AdditionalRAM) and/or our contributing licensors. You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from the game or website without prior written permission.
The Services rely on external platforms to provide online functionality, including:
Your use of these components is subject to the respective terms and privacy policies of those third-party providers. We are not responsible for the availability, uptime, or technical practices of external vendors.
Ember Ruin and the Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.
We do not warrant that the game will operate uninterrupted, secure, or bug-free, or that save data and leaderboard entries will never be subject to corruption, loss, or downtime. You download and use the Services at your own sole discretion and risk.
To the fullest extent permitted by applicable law, neither Ekrem Taha Sener nor AdditionalRAM shall be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, virtual items, virtual currency, device malfunction, or goodwill, arising out of or related to your use of or inability to use the Services.
Nothing in these Terms limits liability for damages resulting from injury to life, body, or health, or liability based on intentional misconduct or gross negligence under applicable German law.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflicts of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer residing within the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. To the extent permitted by law, any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.
We reserve the right to revise or update these Terms at any time. Any changes will be posted directly to this URL with an updated "Last Updated" date. Your continued use of Ember Ruin following any revisions constitutes your acceptance of the new Terms.
